1. INFORMATION FOR THE USER.

Who is responsible for processing your personal data?

NGO Fiet Gratia is RESPONSIBLE for the processing of the USER’S personal data and informs you that these data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of April 27th, 2016 (GDPR) and the Organic Law 3/2018 of December 5th (LOPDGDD).

Why do we process your personal data?

In order to maintain a relationship with the user based on the activities inherent to the development of the activity carried out by the RESPONSIBLE. The operations foreseen to carry out the treatment are:

– To disseminate the activities of the RESPONSIBLE through the issue of informative and commercial communications by e-mail, fax, SMS, MMS, social networks or any other electronic or physical mean, present or future, that makes possible sending out communications to the user. These communications will be made by the RESPONSIBLE and will be related to his products and services, or those of his collaborators or suppliers, with whom he has reached a collaboration agreement. In this case, the third parties will never have access to the personal data.

– To process the economic donations received from the USER.

– To process requests and answer consultations or any type of request that is carried out by the USERS through any of the forms of contact that are put at their disposal in the RESPONSIBLE’s web page.

– To send the online newsletter about news, offers and promotions regarding our activity.

Privacy Policy.

In the event that the Data Controller plans a different subsequent processing, he/she shall provide the concerned party, prior to such subsequent processing, with information about that other purpose and any additional information. The data shall not be processed in a manner that is incompatible with such purposes; further processing of personal data for public interest archiving purposes, scientific and historical research purposes, or statistical purposes, will not be considered incompatible with the initial purposes.

Personal data will not be used for automated processing for profiling, nor will they be used to make any decisions based solely on automated processing, including profiling.

Why can we process your personal data?

Because the treatment is legitimized by article 6 of the GDPR in the following way:

– By the USER’s consent: to the sending of commercial communications and newsletters.

– For the RESPONSIBLE’s legitimate interest: to carry out studies and to process orders, petitions, etc., at the USER’s request.

In the event of a further treatment including special categories of personal data, it will be, in addition, legitimized by art. 9.2.a of the GDPR.

How long will we keep your personal data for?

They will be kept for no longer than necessary to maintain the purpose of the treatment or for no longer than the legal requirements dictate their custody, and when it is no longer necessary to keep them, they will be deleted with the appropriate security measures, in order to ensure the data anonymization or its complete destruction.

To whom do we provide your personal data?

No communication of personal data to third parties is foreseen, except if it is necessary for the development and execution of the treatment purposes, to our service suppliers related to communications, with which the RESPONSIBLE has signed the confidentiality and treatment control contracts required by the current privacy regulations.

The transfer of personal data to third countries or international organizations is not foreseen. In the event that the Data Controller intends to transfer personal data to third countries, he/she must inform the interested party beforehand.

Which are your rights?

The USER’s rights are:

– Right to withdraw consent at any time.

– Rights of access, rectification, opposition, suppression, limitation, and portability of the personal data you have provided.

– Right to file a complaint with the control authority (www.aepd.es) if you consider that the treatment does not comply with the regulations in force.

 2. MANDATORY OR OPTIONAL NATURE OF THE INFORMATION PROVIDED BY THE USER.

The USERS, by marking the corresponding boxes and entering data in the fields marked with an asterisk (*) in the contact form, or presented in download forms, expressly, freely, and unequivocally accept, that their data are necessary for the provider to meet their request. The inclusion of data in the remaining fields is voluntary.

The USER guarantees that the personal data provided to the RESPONSIBLE are accurate, and that he/she is responsible for communicating any changes concerning these data.

The RESPONSIBLE informs that, if all the data required in the forms are not provided, he cannot guarantee that the information and services provided are completely adjusted to the USER’s needs.

3. SECURITY MEASURES.

In accordance with the provisions of the regulations in force on personal data protection, the RESPONSIBLE complies with all the provisions of the GDPR and the LOPDGDD regulations for the processing of personal data for which he is responsible, and, in addition, he clearly respects the principles described in article 5 of the GDPR, by which these data are processed in a lawful, loyal and transparent manner concerning the interested party, and in an appropriate, relevant and limited way, regarding the necessary actions for the purposes for which they are processed.

The RESPONSIBLE guarantees that he has implemented appropriate technical and organizational policies to apply the security measures established by the GDPR and the LOPDGDD, in order to protect the USER’s rights and freedoms, and that he has communicated the appropriate information to them so that they can exercise them.

1.USER INFORMATION.

Who is responsible for processing your personal data?

NGO Fiet Gratia, hereinafter the RESPONSIBLE, informs the USER that has proceeded to create a profile in the social networks Facebook, Instagram, Twitter, and LinkedIn, that, being the responsible for the treatment of the user’s personal data which are present in these social networks, informs the USER that these data will be treated in accordance with the provisions of Regulation (EU) 2016/679 of April 27th, 2016 (GDPR) and the Organic Law 3/2018 of December 5th (LOPDGDD). Therefore, the RESPONSIBLE provides the following information about the treatment:

For what purpose do we process your personal data?

The purpose of the treatment is to maintain a relationship between the USER and the RESPONSIBLE, which may include the following operations:

– To process requests and queries addressed to the responsible.

– To inform the user about activities and events organized by the responsible.

– To be able to collect economic or food donations from the users.

– To inform the user about products or services offered by the responsible.

Why can we process your personal data?

Because the treatment is legitimized by article 6.1.a of the GDPR, through which the interested party has given his/her consent to the treatment of his/her personal data for one or several specific purposes. The USER has a profile in the same social network, and has decided to join the RESPONSIBLE’s social network, showing interest in the information published in it, therefore, at the time of requesting to follow our official profiles, he/she provides his/her consent to the processing of those personal data published in the RESPONSIBLE’s profile.

The USER can access the privacy policies of the concerned social network at any moment, as well as configure their profile to guarantee their privacy.

The RESPONSIBLE has access to and treats the USER’s public information, especially his/her contact name. These data are only used within the social network itself, and will only be included in a file belonging to the RESPONSIBLE when it is necessary to process the USER’s request.

How long will we keep your personal data for?

Data conservation criteria: they will be kept as long as the USER does not revoke the consent, provided as indicated in this Privacy Policy.

To whom do we provide your personal data?

Data communication: the information provided by the USER through the RESPONSIBLE’s social networks, including his/her personal data, may be published, always depending on the services that the USER makes use of, so it may be publicly available to other third-party users of these social networks. From the profile of each social network, the USER can configure what information he/she wants to make public in each case, see the permissions that have been granted, delete them or deactivate them, like any application of a third-party that he/she no longer wants to use.

No communication of personal data to third parties outside the social network is foreseen, except if it were essential for the development and execution of the treatment purposes, to our service suppliers related to communications, with which the RESPONSIBLE has signed the confidentiality and treatment control contracts required by the current privacy regulations.

Which are your rights?

The USER’s rights: These rights can only be satisfied concerning the information under the RESPONSIBLE’s control.

Right to withdraw consent at any time.

Rights of access, rectification, opposition, suppression, limitation, and portability of the personal data you have provided.

Right to file a complaint with the control authority (www.aepd.es) if you consider that the treatment does not comply with the regulations in force.

2.PROFILE USE.

The RESPONSIBLE will carry out the following actions:

– Access the profile’s public information.

– Publication in the USER’S profile of all the information already published in the RESPONSIBLE’s social network.

– Sending personal and individual messages through the social network’s channels.

– Page status updates, that will be published in the USER’S profile.

The USER can always control his/her connections, remove content that no longer interests him/her, and restrict who they share their connections with; in order to do so, they must access their privacy settings.

3.PUBLICATIONS.

The USER, once he/she is a follower or has joined the RESPONSIBLE’s social network, may publish in this platform comments, links, images, photographs, or any other type of multimedia content supported by it. The USER, in all cases, must be the owner of the published content, having the copyright and intellectual or industrial property rights of the mentioned content, or must have the consent of the affected third parties.

Any publication on the social network, whether it is text, graphics, photographs, videos, etc., which violate or are likely to violate morals, ethics, good taste or decorum, and/or which infringe, violate or breach intellectual or industrial property rights, the right to an image or the law, is expressly prohibited.

In these cases, the RESPONSIBLE party reserves the right to immediately withdraw the content, without prior notice, and may request the permanent blocking of the USER.

The RESPONSIBLE will not be held accountable for the contents freely published by the USER.

The USER must bear in mind that his/her publications will be known by other users, therefore, he/she is the main responsible for his/her privacy.

The images that may be published in the social network will not be stored in any file by the RESPONSIBLE, but they will remain in the social network.

4.MINORS OR PEOPLE WITH DISABLING OR INCAPACITATING DISABILITIES’ DATA.

The access and registration through the RESPONSIBLE’s social networks are forbidden to users under 18 years old. If the USER has any disabling or incapacitating disabilities, the intervention of his/her parental authority holder, guardian, or legal representative, will be necessary, which must be accredited by a valid document that proves the mentioned representation.

The RESPONSIBLE will be expressly exonerated from any responsibility that could be derived from the use of the social networks by minors or by people with disabling or incapacitating disabilities. The RESPONSIBLE’s social networks do not consciously collect any personal information from minors, therefore, if the USER is a minor, he/she should not register or use the RESPONSIBLE’s social networks, nor should he/she provide any personal information, the parents or guardians of the minor being responsible for any deriving incident.
